中國擬起草知產反壟斷指南

The National Development and Reform Commission held a preparatory meeting to officially start drafting guidelines for applying the Anti-Monopoly Law to intellectual property right (IPR) abuses.

國家發改委組織召開籌備會議，正式啓動《濫用知識產權反壟斷規制指南》的研究起草工作。

Targeting monopoly agreements related to IPR, abuse of market dominance and concentration of undertakings, the guidelines aim to detail relevant provisions of the Anti-Monopoly Law and offer guidance on when one can claim an exemption.

據悉，《指南》將針對與知識產權有關的壟斷協議、濫用市場支配地位和經營者集中等行爲，細化《反壟斷法》相關條款，特別是對於何種情形可以主張豁免給出具體指引。

Experts say that the guidelines' draft and enactment will have a real impact on the exercise of IPR in sectors such as information and communication and medicine, as well as marketing their products and services.

專家表示，《指南》的起草和頒佈，對信息與通訊、醫藥等領域的知識產權行使行爲以及產品和服務銷售行爲將產生實質影響。
