老人繼承房產"奇遇" 要爲去世百年祖父母開死亡證明

A 67-year-old man has been unable to claim inheritance of his grandparents' apartment because he can't prove they're dead.

近日,一名67歲的老漢無法繼承其祖父母的房產,因爲他無法證明他們已經死亡

Xu Yiqing said the red tape began when authorities in Yichang, Hubei Province refused to put the property in his name without death certificates.

據這位名叫徐義清的老人表示,這件事始於湖北省宜昌市政府拒絕在沒有死亡證明的情況下把這處房產歸到他的名下。

The fact that his grandparents were born over 130 years ago has not convinced the courts or police, Xu said.

據徐義清表示,他的祖父母生於130多年前這個事實並沒有說服法院或者警察。

Xu has been pleading his case to local agencies since 2015 in the hopes they can issue the proper paperwork, reported Xinhua News Agency.

據新華社報道,徐義清於2015年就將他的案子提交給了當地機構,希望他們能夠出具一份適當的文書。

But obtaining death certificates for relatives who were born during the Qing Dynasty (1644-1911) has proven a bit of a challenge.

但是要獲得清朝時(1644-1911)出生親人的死亡證明確實有點困難。

Xu said he even filed a lawsuit against his two sisters - on the advice of their lawyer - in order to show no relatives were contesting ownership.

據徐義清表示,在律師的建議下,他甚至還把自己兩個妹妹告上了法庭,從而證明沒有親戚在爭奪所有權。

But the court ruled against Xu, claiming the three siblings had not proven they were the only ones who stood to inherit the property.

但是法院駁回了徐義清的請求,聲稱這三兄妹不能證明他們是唯一可以繼承這一財產的人。

"The bizarre necessity of this document is a stumbling block that harms social justice and the efficiency of administration," said Wang Shouyi, assistant dean of the Institute of Law and Public Administration, China Three Gorges University.

中國三峽大學法學與公共管理學院副院長王守義說道:“這份文件令人瞠目結舌的必要性,是一個既損害了社會公正,也影響了行政效率的絆腳石。”
