社區矯正 community correction

全國人大常委會近日表決通過的《刑法修正案（八）》規定依法實行社區矯正，這一概念首次被寫入刑法。

社區矯正近日被載入《刑法修正案（八）》，成爲懲罰罪犯的一種方式，並將於5月1日起開始實施。

上述報道中的community correction就是“社區矯正”，是一種不使罪犯與社會隔離並利用社區資源教育改造罪犯的方法，是non-jail punishment（非監禁刑）的一種。較常見非監禁刑的包括reprieve（緩刑）、release on parole（假釋）、community service（社區服務）、halfway house/recovery house（爲長期監禁人員開設的重返社會訓練所）等。

社區矯正適用的罪犯有以下幾種：criminals who commit light offenses（罪行輕微的）、在獄中表現良好的、以及在特定條件下 executing sentences out of jail（監外服刑）的罪犯等。
